HOME INSPECTION AGREEMENT
THIS IS A LEGALLY BINDING CONTRACT. PLEASE READ CAREFULLY. YOU SHOULD SEEK THE ADVICE OF AN ATTORNEY PRIOR TO SIGNING IF YOU DO NOT FULLY UNDERSTAND THIS AGREEMENT.

For a fee of $_____________ the Inspector(s) agrees to inspect the house for the purpose of informing the client as to major defects or deficiencies, visually observed, which could significantly impact the value of the property. The services and limitations outlined in this agreement pertain solely to The Company’s basic visual home inspection. The Client must authorize any additional services which The Company may offer. The inspection will generally cover the following, unless otherwise directed by the client or circumstances prevent (Not all items apply to every inspection) :

This inspection is performed in accordance with and exceeds the STANDARDS OF PRACTICE of the American Society of Home Inspectors and/or the National Association of Home Inspectors. We report visible defects and deficiencies (based upon non-invasive visual observation only) noted on the day of the inspection. Inspections performed according to these standards are not technically exhaustive, nor do they imply that every component was inspected, nor imply that every defect or deficiency was discovered. It is intended only as a general guide to help the client make an evaluation of the overall condition of the property. The Inspector(s) is not required to move furniture, personal goods or equipment, which may impede or limit visibility.
The Inspector is not required to inspect storm doors, storm windows, awnings or other such accessories. Security systems, timers, fences, water conditioning systems, intercoms, entertainment systems and components, swimming pools, wells, and septic system tank and fields are not inspected. Soil conditions, geological stability, and engineering analysis are beyond the scope and intent of this report. The inspection does not determine compliance with manufacturer’s specifications; past or present. Maintenance and cosmetic items may be discussed but are not part of this inspection.
THE INSPECTION AND REPORT ARE NOT INTENDED TO BE USED AS A GUARANTEE OR WARRANTY; EXPRESSED OR IMPLIED REGUARDING THE ADEQUACY, PERFORMANCE OR CODITION OF ANY INSPECTED STRUCTURE, ITEM, OR SYSTEM. THE COMPANY IS NOT AN INSURER OF ANY INSPECTED CONDITION FOR ANY PERIOD OF TIME. The inspection is not a compliance inspection or certification for past or present governmental or local codes or regulations. The inspection will not determine the operational capacity, quality or suitability for a particular use of items examined. The inspection does not include air or water quality. The presence or absence of asbestos, safety glass, radon, lead paint or any toxic or hazardous materials or substance, environmental hazards, noise, insects or pests is beyond the scope and purpose of this inspection. The inspection does not meet state requirements for termite and wood destroying organism inspection and is not part of this inspection. Detached buildings are included only if specifically agreed to in advance of the inspection.
Estimates for repair costs are to be used as a guide only. Actual repair costs must be determined by the Client prior to closing. Do not rely on cost estimates in the Report.
Settlement Clause. Any controversy or claim arising out or, relating to, or in connection with this contract, or the breach thereof, shall be settled by a court of jurisprudence having jurisdiction over such matters in the county of The Company’s headquarters. The Company may, at its discretion, pursue its legal interests under this agreement in any court of legal jurisdiction.
The Client agrees to notify The Company by telephone and in writing on any item in question and to allow the inspector access to the property to evaluate these items before any corrective action is taken. The Client agrees and understands that any repairs or corrective action taken without consultation with The Company relieves The Company of any and all liability. Any legal action must be brought within one (1) year from the date of the inspection.
Limit of Liability. THE CLIENT AGREES AND UNDERSTANDS THAT THE MAXIMUM LIABILITY INCURRED BY THE INSPECTOR(S) AND / OR THE COMPANY FOR ERRORS AND OMISSIONS IN THE INSPECTION SHALL BE LIMITD TO THE AMOUNT OF THE FEE PAID FOR THE INSPECTION AND REPORT OR $500.00, WHICH EVER AMOUNT IS GREATER.
The Company will prepare and provide a copy of “The HomeCheck Pro LLC Building Analysis Report” to the Client. The Report is prepared for the sole use by the client and comprises the full inspection report. Payment for services is due at the completion of the Report. Under no circumstances shall the inspection be considered for use by a third party. The Company will discuss and supply a copy of the Report to the Client only, unless directed herein to do otherwise:

Should any portion of this agreement be determined invalid or unenforceable by law, all remaining provisions remain enforceable and in full force and effect.
